GASP of Colorado (Group to Alleviate Smoking Pollution)

Some local laws have provisions that are stronger than the Colorado Clean Indoor Air Act and provide better protection from exposure to secondhand smoke at work and in public places. GASP of Colorado rates local laws compared to the state law on a scale of zero to five.  The highest and best rating is a five (click here for an explanation of our rating system).  Any stronger provisions in the state law take precedence over any weaker local provisions so the state law should be reviewed first through these links: smokefreecolorado.org or gaspforair.org.

 

This local law provides more protection from secondhand smoke than the state law in the following area(s):

 

Work Places: (3) county-owned buildings only

The Board of County Commissioners met in regular session in its office in Pueblo County, Colorado, on Wednesday the 6th day of October A.D.1993 , at 10:00 o'clock. Present: Richard A. Martinez Chairman. Pro Tem " James M. Brewer County Commissioner. " County Commissioner. " Terry A. Hart County Attorney. " Lucille Wilson Deputy County Clerk or Deputy.

 

When the following proceedings, among others, were had and done, to wit. RESOLUTION NO. 93-432 APPROVING AND ENACTING THE PUEBLO COUNTY, COLORADO WORKPLACE SMOKING POLICY

 

WHEREAS, pursuant to ¤30-11-103, C.R.S., the Pueblo County Board of County Commissioners is authorized to administer Pueblo County, Colorado; and WHEREAS, specifically included within that authority, the Board is empowered to make such orders concerning County property and buildings as it deems expedient, pursuant to ¤30-11-107, C.R.S.; And

 

WHEREAS, pursuant to ¤¤25-14-104 and 105, C.R.S., this Board is authorized to regulate smoking within Pueblo County's property and buildings; and WHEREAS, medical research has concluded that smoking causes lung cancer, heart disease, and emphysema, may complicate pregnancy, may cause acute and chronic lung disease, and may cause carcinoma of the lung in non-smokers; and

 

WHEREAS, the cost to employers to provide health care to employees who smoke and to nonsmoking employees who are affected by second-hand smoke is increasing dramatically each year; and

 

WHEREAS, this Board deems it in the bests interests of Pueblo County employees, the patrons of Pueblo County buildings, and the taxpayers of Pueblo County to adopt a workplace smoking policy.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pueblo County, Colorado, that the Pueblo County, Colorado Workplace Smoking Policy, dated October 6, 1993, the terms and conditions of which is attached hereto and incorporated herein by this reference, be, and hereby is approved.

 

BE IT FURTHER RESOLVED that Subject 6.06 of the Personnel Policies and Procedures of Pueblo County, Colorado, be, and hereby are, repealed and replaced by this Pueblo County, Colorado Workplace Smoking Policy.

 

BE IT FURTHER RESOLVED that the Chairman Pro Tem of the Board be, and hereby is, authorized to notify Pueblo County employees of the terms and conditions of the Pueblo County Workplace Smoking Policy.

 

PUEBLO COUNTY, COLORADO

WORKPLACE SMOKING POLICY PURPOSE:

To protect the health and comfort of all employees, visitors, and the general public who work or do business in County buildings, and to avoid conflicts between smokers and nonsmokers.

 

GUIDELINES:

1) Smoking is permitted outdoors.

2) Smoking is prohibited in all lobbies, hallways, stairwells, elevators, restrooms, lounges, cafeterias or snack bars, conference rooms, public areas, and County-owned vehicles effective 10/15/93.

3) Smoking is further prohibited in all offices and any parts of County buildings effective 1/l/94. The interiors of all County buildings and vehicles will then be entirely "smoke-free."

4) Employees who smoke are encouraged to enroll in either a worksite smoking-cessation program or outside programs sponsored by local agencies and organizations. The Personnel/Human Resources Department will provide information on these programs and assist employees in accessing them.

5) The County will be responsible for supplying all no-smoking signs, notices, and postings used on the premises.

6) Violators of the smoking restrictions set forth in this policy will be subject to the standard disciplinary penalties, i.e., first offenses will elicit an oral warning, second offenses a written warning, etc.
